Privacy Notice on the Protection of Personal Data

Makfen Makine Kimya İnşaat Mühendislik Sanayi ve Ticaret Limited Şirketi (“Makfen”), acting as data controller, processes the personal data of visitors to https://www.makfen.com (the “Website”) in accordance with Turkish Personal Data Protection Law No. 6698 (“KVKK”). This notice is issued to fulfil the duty to inform under Article 10 of the KVKK. The cookies used on the Website are described separately in the Cookie Policy.

Makfen does not request special categories of personal data through the Website; please do not share such information in the forms.

3. How Personal Data Is Collected

Your personal data is collected directly from you when you fill in the contact form or send us an e-mail, and by automated means through server logs and cookies while you browse the Website. The types, durations and management of cookies are explained in the Cookie Policy; you can change your cookie preference at any time via the “Cookie settings” link at the bottom of each page.

4. Transfer of Personal Data

Limited to the purposes above and in accordance with Articles 8 and 9 of the KVKK, your personal data may be transferred to the following recipients:

Our service providers: The Website and contact form records are stored on the servers of our hosting provider in Türkiye; form messages are forwarded to Makfen by e-mail.
Competent public authorities and judicial bodies: Within the scope of our legal obligations and upon request.
Service providers located abroad: Cloudflare (Cloudflare, Inc.) for the security and speed of the Website; with your explicit consent, Google Analytics and Google Ads (Google Ireland Limited / Google LLC) for measurement and advertising; OpenStreetMap for the map on the contact page; Microsoft 365 (Microsoft) for our corporate e-mail infrastructure. When these services are used, your IP address, browser and device information, cookie data and the content of e-mails you send us may be transferred to these providers’ servers abroad.

Transfers abroad are carried out in accordance with the conditions set out in Article 9 of the KVKK. Transfers based on analytics and advertising cookies take place only with your explicit consent, which you may withdraw at any time.

5. Retention Periods and Data Security

Your personal data is retained for as long as required by the purpose of processing and for the periods stipulated in the applicable legislation:

Contact form and e-mail correspondence: After your request has been handled, for the statutory limitation periods, as evidence in the event of a dispute.
IP record of form submissions and server access logs: For a limited period, for security purposes.
Cookies: For the periods stated in the Cookie Policy.

Data whose retention period has expired is deleted, destroyed or anonymised.

Makfen takes the necessary technical and organisational measures to prevent unlawful processing of and unauthorised access to personal data, including encrypted connections (HTTPS), access authorisation and protection against automated form submissions. If personal data is obtained unlawfully by third parties, the data subjects and the Turkish Personal Data Protection Board are notified in accordance with Article 12 of the KVKK.

6. Your Rights under the KVKK

Under Article 11 of the KVKK, by applying to Makfen you have the right to:

learn whether your personal data is processed;
request information if it has been processed;
learn the purpose of processing and whether the data is used in line with that purpose;
know the third parties to whom your data is transferred, in Türkiye or abroad;
request correction if your data is incomplete or inaccurate;
request erasure or destruction of your data under the conditions set out in Article 7 of the KVKK;
request that correction, erasure and destruction be notified to the third parties to whom your data has been transferred;
object to a result to your detriment arising from the analysis of your data exclusively by automated systems;
claim compensation for damage suffered as a result of unlawful processing of your personal data.

For erasure requests, please use the subject line “Kişisel Verilerin Silinmesi Talebi” (Request for Erasure of Personal Data) so that your request can be handled more quickly.

In accordance with the Turkish Communiqué on the Procedures and Principles of Application to the Data Controller, requests must be submitted in Turkish via one of the following channels:

by e-mail to [email protected], sent from the e-mail address you previously provided to Makfen and held in our records, or signed with a secure electronic signature or mobile signature;
in writing, together with documents verifying your identity, delivered in person or via a notary to Pelitli Mah. Tavşanlı Yolu, 4761 Sk No:3, 41400 Gebze/Kocaeli, Türkiye.

The request must include your name and surname, your Turkish ID number (for foreign nationals, nationality and passport or ID number), your address for notification, your e-mail address and telephone number if any, and the subject of the request. Requests are concluded free of charge within 30 days at the latest; if the procedure incurs an additional cost, the fee determined by the Turkish Personal Data Protection Board may be charged.

This notice may be updated in line with changes in legislation and in our processes; the current version is always published on the Website. The notice has been prepared in Turkish; versions in other languages are provided for information only, and in the event of any discrepancy the Turkish text prevails.
