Makfen Makine Kimya İnşaat Mühendislik Sanayi ve Ticaret Limited Şirketi (the “Company” or “Makfen”), located at Pelitli Mah. Tavşanlı Yolu, 4761 Sk No:3, 41400 Gebze/Kocaeli, exercises the utmost care to process and protect the personal data of persons visiting its official website at https://www.makfen.com (the “Website”) in accordance with Law No. 6698 on the Protection of Personal Data (“KVKK”) and its secondary legislation (the “KVK Legislation”).

This Privacy Notice has been prepared so that Makfen, in its capacity as data controller, fulfils the duty to inform arising from Article 10 of the KVKK.

The company name field in the contact form is optional and is processed only if you fill it in. Your telephone number is collected together with the country you select (country code).

2. Cookies and third-party services

Cookies are small text files stored in your browser when you visit the Website. The cookies and third-party services used on the Website are as follows:

Strictly necessary cookies: PHPSESSID (session cookie; deleted when the browser is closed) and mk_cerez (your cookie preference; 1 year). Without these cookies, the Website and the contact form do not function properly.
Analytics and advertising cookies: Google Analytics (_ga, _ga_*; up to 2 years) and Google Ads (_gcl_au; 3 months). They are provided by Google LLC and Google Ireland Limited and are activated only with your explicit consent.
Map: The map on the contact page is loaded from the OpenStreetMap infrastructure; in the process, your IP address and browser information are transmitted to the map servers.
Videos: When videos are played via YouTube (Google), YouTube’s own cookies and privacy terms apply.

You can set your cookie preference in the cookie banner displayed on your first visit, change it at any time via the “Cookie settings” link at the very bottom of the page, and withdraw the consent you have given. You can also delete or block cookies through your browser settings.

3. Transfer of personal data

Your personal data may be shared, limited to the purposes stated above and in accordance with Articles 8 and 9 of the KVKK, with our suppliers from whom we obtain the hosting and email services for the Website and, for the purpose of fulfilling our legal obligations, upon request, with authorised public institutions and organisations and judicial authorities. These suppliers are obliged to process and protect the data shared with them solely in accordance with our Company’s instructions.

The servers of the Cloudflare (Cloudflare, Inc.) service used for the security and speed of the Website, of the OpenStreetMap map service on the contact page and, if you give your explicit consent, of the Google Analytics and Google Ads services may be located abroad. When these services are used, your IP address, browser and device information and cookie data may be transferred abroad to these service providers. Such transfers are carried out in accordance with Article 9 of the KVKK; transfers made by means of analytics and advertising cookies take place only if you have given your explicit consent.

4. Retention period, security and destruction

Your personal data are retained for the period required by the purpose of processing and for the periods prescribed in the relevant legislation. Data submitted via the contact form and by email are retained, after your request has been concluded, for the statutory limitation periods in view of potential disputes; traffic data are retained for the period prescribed in Law No. 5651 and its secondary legislation. Data whose retention period has expired are deleted, destroyed or anonymised.

Makfen takes the technical and administrative measures required by the KVK Legislation to prevent unauthorised access to your personal data and the unlawful processing, disclosure, alteration or deletion of the data.

If the processed personal data are obtained by others through unlawful means, this is notified, pursuant to Article 12 of the KVKK, to the data subjects concerned as soon as possible and to the Personal Data Protection Board within 72 hours at the latest.

5. Your rights

Pursuant to Article 11 of the KVKK, you may exercise the following rights by applying to Makfen:

To request information in this regard if your personal data have been processed,
To learn the purpose of the processing of your personal data and whether they are used in accordance with that purpose,
To know the third parties in Turkey or abroad to whom your personal data are transferred,
To request the rectification of your personal data if they have been processed incompletely or inaccurately,
To request the erasure or destruction of your personal data within the framework of the conditions set out in Article 7 of the KVKK,
To request that the rectification, erasure and destruction operations be notified to the third parties to whom your personal data have been transferred,
To object to the occurrence of a result to your detriment through the analysis of the processed data exclusively by means of automated systems,
To request compensation for the damage if you suffer damage due to the unlawful processing of your personal data.

6. Method of application and erasure requests

When submitting an erasure request, writing “KVKK – Kişisel Verilerin Silinmesi Talebi” (KVKK – Request for Erasure of Personal Data) in the subject line of the email will allow your request to be processed more quickly.

Your application must include your name and surname; for Turkish citizens, your Republic of Türkiye (T.C.) identity number; for foreign nationals, your nationality and your passport or identity number; your place of residence or business address for service of notices; your email address for notifications, if any; your telephone number; and the subject of your request. Pursuant to the Communiqué on the Procedures and Principles of Application to the Data Controller, applications are made in Turkish. You may submit your application by the following means:

By email to [email protected], from the email address you have previously notified to our Company and which is registered in our system, or signed with a secure electronic signature or mobile signature,
In writing, delivered by hand in person or through a notary public, to Pelitli Mah. Tavşanlı Yolu, 4761 Sk No:3, 41400 Gebze/Kocaeli, together with documents evidencing your identity.

Your applications will be concluded free of charge as soon as possible, depending on the nature of the request, and within 30 (thirty) days at the latest. If the procedure additionally entails a cost, the fee set out in the tariff determined by the Personal Data Protection Board may be charged. If your request is rejected, the reasons for the rejection will be notified to you in writing or electronically.

7. Amendments and language of this notice

This Privacy Notice may be updated in line with changes in the legislation and in our Company’s processes. The current version is always published on the Website.
